Laws relating to domestic violence and dowry harassment are the most misused’. The Supreme Court has said this on Wednesday. Justice BR Gavai, Justice Prashant Kumar Mishra and Justice K.V. Viswanathan’s bench said this while hearing a dispute in a matrimonial case. Justice Gavai, hearing the issue of subsistence allowance, said that the best thing to do in such a case is to get freedom. Elaborating on his comment, Justice Gawai also recalled a case. He said that there was a case in which the husband did not spend even a day with his wife. But when they separated, he had to pay Rs 50 lakh to his wife. Justice Gavai said, I had seen such a case in Nagpur. In that case, the young man went to America and settled. Their marriage did not last even a day but the wife had to pay 50 lakh rupees due to the pending case. I openly say that the most misused laws are those related to domestic violence and dowry harassment. Maybe you guys will agree with me. Section 498A has been debated for a long time. Critics of this law have been saying that often the family of the woman abuses this law. As the relationship deteriorates, threats are made to implicate the husband and his family. Often false cases are filed and later settled. Courts are also raising questions regarding these matters. Last year, in a case registered regarding Section 498A, the Bombay High Court made a scathing comment. The court said that why the husband’s grandparents and family members who fell ill at home were also brought up in this case.
