The Gujarat Police has come to the rescue of registering an online FIR. Now an application has been implemented in Gujarat that allows the panchnama to be submitted directly to the court in any crime. Police officers in all police stations of the state who have the authority to investigate crimes have been made to download the e-Sakshya application on their mobile phones. With this application called Sakshya, the panchnama made by the police at the crime scene is directly submitted to the court. However, the police want to solve some problems that arose at the beginning of the application. With the implementation of new laws, the e-Sakshya application has come in which the investigating police personnel, officers have to videograph the witness, panchnama, and the proceedings on their mobile phones and send it live from the spot on this application. The investigating police officer has to upload his selfie, photograph of the complainant, photographs of two panchayats, name and address along with details in this application. It has been made mandatory for the investigator to upload the videography of the place where the incident took place in the application downloaded on the mobile phone since last July. These details are directly deposited in the court where the incident took place. When this application is uploaded, the police get the certificate of e-evidence panchayat online. The police are also troubled by the errors in this new modern system. The problem is that the police have to prepare three CDs or three pen drives of this e-evidence panchayat. Within 48 hours, these CDs or pen drives are asked to be sealed in the presence of the original panchayats and presented in the court. The other pen drive has to be stored systematically. This system, which was implemented since last July, is not being implemented in many police stations of the state, including Ahmedabad.
The situation has arisen that when a chargesheet is filed for a crime within 60 or 90 days, the court asks for a CD or pen drive. Due to the inability to produce a CD with videography and photographs, a new problem has arisen that the court is not accepting the chargesheet. The pain of the police is that no training has been given on e-evidence, nor are CDs or pen drives given to the police. The police have to do panchnamas in their daily work. Therefore, the question is whether they can properly complete the work of taking photographs while the current work on the complaint is still the same. The police have been urged to implement the standard operating procedure, which is being implemented since July. It has been made mandatory for the investigating officer to upload the details of the panchnama in e-evidence in any crime. Along with this, the details of the name, address and photograph of the Panchnama also have to be recorded in this application. This application keeps on updating and has to be uploaded continuously. During this, the police have complained that the previous data is also being missed. Amidst many issues including any problem with the application, providing an explanation of how to use it, internet connectivity, the e-evidence application has become a headache for the police at present.
