Corruption In Gujarat: In Gujarat, the state government has prepared a new law to confiscate properties collected through corruption or crime. In this regard, the Gujarat Special Court Bill 2024 will be introduced in the ongoing monsoon session of the Legislative Assembly. In which a special court will be constituted for speedy justice of crime and cases of accumulated wealth. The objective of this bill is that, a large number of persons are involved in committing crime and as a result of committing crime accumulate large amount of property from income other than their legitimate sources. They continue to use such property and proceeds from it to further their criminal activities. Delays in the criminal procedure and confiscation of assets in this activity allow such persons to continue their criminal activities. This has led to the need to constitute a special court for expeditious seizure of properties found to be involved in the investigation of criminal cases. This court will act for confiscation of properties against a person involved in such activity keeping in mind the legal or moral obligation of the State to curb such criminal activities. The Bill includes any property acquired or obtained directly or indirectly by a person by committing an offense having a total value of more than one crore rupees, which shall apply to an individual, family, company, firm, association of persons and other agencies. The Court will be presided over by a Judge nominated by the State Government with the concurrence of the High Court. This Court shall take judicial notice of the cases brought before it or transferred to it under Section-10 and shall take judicial action. Action will be taken on the basis of the report of the Inquiry Officer received through the concerned officer not below the rank of Superintendent of Police. A special court may impose on a person convicted by it the punishment authorized by law for the offense of which such person has been convicted. An appeal may be made to the High Court against the judgment of this Court, but no appeal shall lie to any Court against the judgment, sentence or order of the Special Court or for writ of certiorari or review. However, the investigating officer has to issue a notice of seizure. If the market value of the seized property is deposited with the authorized officer, the property shall not be confiscated.
